Acceptance of terms
By accessing or using Omesta ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.
Description of service
Omesta is a revenue recovery platform for businesses of all kinds. The Service includes:
- Automated payment recovery through intelligent retry timing and dunning email campaigns
- Ad attribution tracking and leak detection across Meta and Google advertising platforms
- Conversion tracking via first-party pixel technology
- AI-powered business insights and optimization recommendations
- Campaign performance monitoring and, where you enable it, automated campaign management — including AI-assisted drafting, launching (created paused by default), budget adjustment, and pausing of campaigns within rules and caps you configure
Account registration
To use the Service, you must create an account using a valid email address or Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
You must provide accurate, current, and complete information during registration and keep your account information updated.
Billing and payment
New users access Omesta free of charge. No payment method is collected at signup. The full platform runs against your account from the moment connections are authorized and continues to run free of charge until the earlierof the two value thresholds below is reached ("whichever comes first"). If neither threshold is ever reached, no charge is made and the user owes nothing for the work performed.
- Threshold A — $1,000 of Value Delivered."Value Delivered" means the sum of (a) processor-verified recovered revenue (failed payments recovered via your connected payment processor because of the Service) and (b) the estimated savings of ad-spend leaks that you reviewed and marked as fixed inside the dashboard. Either component alone can reach the threshold. The dashboard shows the running total at all times.
- Threshold B — 100 combined ad conversions.The advertisements in your connected advertising accounts record one hundred (100) or more conversions in aggregate (summed across all ads and connected ad platforms), as reported by the advertising platforms' APIs (subject to any primary-conversion setting on your account), measured from the date each advertising platform connection was authorized. Conversions occurring before you connected a platform do not count.
- Measurement.Both thresholds are measured by Omesta from your connected platforms' APIs and Omesta's own records, and Omesta's determination of when a threshold is crossed is conclusive absent manifest error. Disconnecting and reconnecting platforms, operating multiple accounts for the same business, or otherwise interfering with measurement does not reset a threshold; in such cases Omesta may determine crossing from the data available to it and may suspend accounts that attempt to circumvent this section.
- Free access window: No card, no charge, and no automatic conversion before a threshold is crossed. The user may close the account at any time during this window and walk away with whatever value was delivered.
- Subscription plans: The day either threshold is crossed, the user is prompted to select a monthly subscription (Starter, Growth, or Scale) to continue access. Plan options and prices are presented inside the dashboard at the time of selection and are billed via Stripe.
- Subscription refunds:If, in the first thirty (30) days of a paid subscription, the Service delivers no measurable value — meaning it neither recovers revenue at least equal to your first month's subscription fee nor do your connected advertising accounts record one hundred (100) or more platform-reported conversions in aggregate during that period — you are eligible for a full refund of that month upon request.
All prices are in USD unless otherwise specified. Applicable taxes may be added to your subscription.

Case-study consent
The pricing structure in section 04 — free access until a value threshold is crossed, with no card collected before that point — is sustained by the case-study rights granted at signup. By creating an account, whether via email/password or Google OAuth, you acknowledge and agree to the following:
- Trigger. Case-study rights vest the first day either value threshold defined in section 04 is crossed on your account (whichever comes first). They do not vest before that day, and they remain in effect after that day irrespective of whether you continue your subscription.
- Scope of permitted use. Once vested, you grant Omesta a perpetual, worldwide, royalty-free, non-exclusive licence to publish and reference: (a) your business or trading name, (b) the public URL of your store or website, (c) the total recovery amount delivered through the Service, (d) the recovery method or category (e.g. dunning, retry timing, ad-leak fix), and (e) the timeframe over which the recovery occurred. Omesta may use this material in marketing pages, sales materials, decks, partner-facing collateral, social posts, blog content, and case-study videos.
- Personal-name opt-out. The licence above does not extend to founder, employee, or operator personal names by default, we use the business name. If you would prefer that any personal names also be referenced (e.g. a quote attributed to a named person), Omesta will request that separately. You may opt out of personal- name use at any time, before or after publication, by emailing support@omestasystems.com; we will remove personal-name references on a best-effort basis within thirty (30) days of receipt.
- No private financial data. Omesta will not publish customer-level data, transaction-level data, payment-processor account identifiers, or any data that could identify your individual end-customers. The licensed material is limited to aggregate recovery figures and the categorical metadata described above.
- Pre-publication notice. Where Omesta produces a long-form case study (a written page, a video, or sales-deck content of a comparable depth), Omesta will email a draft to the address on your account at least seven (7) days before publication so you can flag factual corrections. Aggregate references in social posts, marketing pages, and partner decks do not require pre-publication notice provided they are limited to the categories enumerated above.
- Confidentiality carve-out. Nothing in any non-disclosure agreement, mutual NDA, master services agreement, or other confidentiality arrangement between you and Omesta limits the licence granted under this section. By accepting these Terms you confirm that you have authority to grant this licence on behalf of your business and that doing so does not breach any third-party agreement.
- Survival. The case-study licence survives termination of your subscription and termination of these Terms. Cancelling your subscription does not revoke case-study rights once they have vested.
- Versioning & audit. The version of this clause in effect at the time you accepted it is recorded server-side along with a timestamp, IP, and user-agent. If we materially change this clause we will ask you to re-consent to the new version; the previously accepted version remains binding for the recovery delivered up to that date.
If you do not agree to this clause, do not create an Omesta account, the offer in section 04 is conditional on it. Existing accounts that predate the introduction of this clause are subject to the version of the Terms in effect on the date of their original acceptance.
Platform connections and data access
By connecting your advertising platforms (Meta Ads, Google Ads) and payment processor (Stripe) to Omesta, you grant us API access to the data necessary to provide our services. By default, this access is used in read-only mode to surface analysis and recommendations. Write-capable scopes (for example, the Google Ads adwords scope, which permits pausing assets) are exercised only when you explicitly enable a specific Autopilot module from within your dashboard; every Autopilot action is logged and reversible. We will not modify your ad campaigns, payment settings, or customer data outside the scope of an Autopilot module you have explicitly enabled.
Sharing your customer data with Google (Data Manager / Customer Match). The Google Ads connection also requests the Google Data Manager scope (datamanager), which Omesta uses to send your first-party conversion events for conversion measurement. When you explicitly upload a consented customer list or enable Omesta's Converter Vault, Omesta uses Google Data Manager to send a Customer Match audience for improved targeting. The customer identifiers we send (email addresses and phone numbers) are hashed with SHA-256 before leaving Omesta. By enabling or keeping this connection active, you represent and warrant that: (a) you collected this customer data directly from your customers in a first-party context; (b) you have provided the notices and obtained the consents required by applicable law and by Google's policies to share it with Google and to have Google use it for these purposes — including, for customers in the European Economic Area, the United Kingdom, and Switzerland, the consent required by the Google EU User Consent Policy and the Google Ads Customer Match policies; and (c) you will maintain records of that consent. You may disable this send-back at any time by disconnecting Google Ads. Omesta transmits this data only at your direction and on your behalf.
Automated actions and advertising spend. Autopilot modules you enable may, within the rules and caps you configure, create, modify, pause, or resume campaigns, ad sets, and ads, and adjust budgets on your connected advertising accounts. You acknowledge that: (a) advertising spend charged by Meta, Google, TikTok, or any other platform is charged by that platform to you, not by Omesta, and remains your responsibility; (b) advertising outcomes (delivery, cost per result, conversions, learning-phase behavior) are determined by the advertising platforms and are not guaranteed by Omesta; (c) you remain responsible for supervising your advertising accounts and may disable any Autopilot module, or pause any campaign, at any time; and (d) Omesta acts as a software tool at your direction — it is not your advertising agency, broker, or fiduciary, and its recommendations, scores, and AI-generated drafts are informational, not professional advice.
Use, sharing, and retention of Google user data obtained through these connections is governed by the Google API Services User Data Policy, including the Limited Use requirements. The full sharing disclosure (subprocessors, purposes, the customer data we send to Google via the Data Manager API, what we do not do with Google user data, and how to revoke access) is in section 09 of our Privacy Policy.
You represent that you have the authority to grant this access and that doing so does not violate any agreements with third parties.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the Service or its systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to send spam, phishing, or otherwise abusive communications
- Share your account credentials with unauthorized third parties
- Exceed reasonable usage limits or abuse the API rate limits
Intellectual property
The Service, including its software, design, content, and branding, is owned by Omesta and protected by intellectual property laws. You retain ownership of your data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.
Limitation of liability
To the maximum extent permitted by law, Omesta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Without limiting the foregoing, Omesta is not liable for advertising spend or other charges billed to you by advertising platforms or payment processors, for changes in campaign delivery or performance, or for actions taken by those platforms against your accounts — including where such spend, changes, or actions occur in connection with an Autopilot module you enabled under section 06.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to Omesta in the twelve (12) months preceding the claim. For accounts that have not paid any fees, our total aggregate liability shall not exceed one hundred dollars ($100).
You agree to indemnify and hold Omesta harmless from claims arising out of your advertising content, your products or services, your use of the Service in violation of these Terms, or your violation of applicable law or third-party rights (including advertising-platform policies).
Termination
You may cancel your subscription at any time from your dashboard. Upon cancellation, you will retain access to the Service until the end of your current billing period. We may terminate or suspend your account immediately if you violate these Terms.
Upon termination, we will provide you the ability to export your data. After a 30-day grace period, your data will be permanently deleted from our systems.
Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will achieve specific revenue recovery results. Omesta may optimize, recommend changes to, or scale an advertisement that has shown positive historical performance, but past performance does not guarantee future results. Advertising performance can change at any time due to platform delivery, audience response, competition, creative fatigue, tracking accuracy, market conditions, and factors outside Omesta's control. Omesta does not guarantee advertising performance, conversions, revenue, return on ad spend, lead volume, approval, or delivery.
Governing law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national law of the Netherlands, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of the Netherlands.
Changes to terms
We reserve the right to modify these Terms at any time. We will notify you of material changes at least 30 days in advance via email or through the Service. Your continued use after the effective date constitutes acceptance of the updated Terms.
