Terms of Service

1. Acceptance of Terms

By accessing or using Omesta ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

Omesta is a revenue recovery platform for e-commerce businesses. The Service includes:

  • Automated payment recovery through intelligent retry timing and dunning email campaigns
  • Ad attribution tracking and leak detection across Meta and Google advertising platforms
  • Conversion tracking via first-party pixel technology
  • AI-powered business insights and optimization recommendations
  • Campaign performance monitoring and autopilot management

3. Account Registration

To use the Service, you must create an account using a valid email address or Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

You must provide accurate, current, and complete information during registration and keep your account information updated.

4. Billing and Payment

Omesta offers a 14-day free trial for all new subscribers. After the trial period, you will be billed according to your selected subscription plan.

  • Performance-based pricing: Our recovery services operate on a percentage of revenue actually recovered. You only pay for results.
  • Subscription plans: Monthly subscription fees vary by plan tier (Starter, Growth, Scale) and are billed via Stripe.
  • Refunds: If our service does not recover at least the equivalent of your subscription fee within the first 30 days, you are eligible for a full refund.

All prices are in EUR unless otherwise specified. Applicable taxes may be added to your subscription.

5. Platform Connections and Data Access

By connecting your advertising platforms (Meta Ads, Google Ads) and payment processor (Stripe) to Omesta, you grant us read-only access to the data necessary to provide our services. We will not modify your ad campaigns, payment settings, or customer data without your explicit instruction.

You represent that you have the authority to grant this access and that doing so does not violate any agreements with third parties.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to send spam, phishing, or otherwise abusive communications
  • Share your account credentials with unauthorized third parties
  • Exceed reasonable usage limits or abuse the API rate limits

7. Intellectual Property

The Service, including its software, design, content, and branding, is owned by Omesta and protected by intellectual property laws. You retain ownership of your data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Omesta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to Omesta in the twelve (12) months preceding the claim.

9. Termination

You may cancel your subscription at any time from your dashboard. Upon cancellation, you will retain access to the Service until the end of your current billing period. We may terminate or suspend your account immediately if you violate these Terms.

Upon termination, we will provide you the ability to export your data. After a 30-day grace period, your data will be permanently deleted from our systems.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will achieve specific revenue recovery results. Past recovery performance does not guarantee future results.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national law of the Netherlands, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of the Netherlands.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes at least 30 days in advance via email or through the Service. Your continued use after the effective date constitutes acceptance of the updated Terms.
